Copyright, Modification, and Distribution of Materials,
Thanks for visiting my web site!
You should know that I am not part of a large corporation or even a small company. I am retired and create this stuff in my home. Please read the following before reaching for the phone to call your lawyer.
The materials and any software contained on this site are offered without warranty or guarantee of any kind, either express or implied, including but not limited to implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, noninfringement, or those arising by law, statute, usage of trade, course of dealing or otherwise, and are provided on an "as is," and "with all faults" basis. The entire risk as to the results and performance of these materials is with you. Shoud any materials or software prove defective, you assume the cost of all necessary servicing, repair, or correction. The author assumes no liability whatsoever to you or any other entity or third party for any special, incidental, direct, indirect, or consequential damages -- including without limitation any damages to equipment, or for loss of profits, for business interruption, for loss or corruption of data or other information, or for any other loss to you or any third party arising out of the use or inability to use these materials, techniques, suggestions, or software programs, even if the author has been notified of the possibility or actuality of such damages, or they are foreseeable. Materials on these pages have been prepared with reasonable care for educational and informative purposes. No representations are made regarding the use or the results of the use of any software, suggestion, technique, or other material in terms of their correctness, accuracy, reliability, or otherwise, and you are again cautioned that you use them solely at your own risk. You are advised to make backups of any important files before implementing any macro, suggestion, or technique. Do not assume anything on this site or any linked site is error free.
The above Disclaimer also applies to any communication the author may have with you.
If the disclaimer of warranty and limitation of liability provided above cannot be given local legal effect according to their terms, reviewing courts shall apply local law that most closely approximates an absolute waiver of all civil liability in connection with the materials and software on this site, or that may be contained in any communication with the author.
The external links on this site, or in any related materials or communications, do not constitute an endorsement or guarantee of the linked sites, their visitors, or their associated owners, operators or staff.
COPYRIGHT: The author (that's me) retains copyright to all materials on this site, with the exception of those materials clearly belonging to or copyrighted by others.
RESTRICTIONS AND PERMISSIONS: There are no restrictions on your own private use of the author's own materials posted on this site, including using them within your organization for internal use only. Note that publishing them without prior written permission on a publicly accessible Internet site does not constitute private use. (It is much better to provide a link to the materials, which will help ensure that other people receive the most up-to-date versions of the materials.)
The author grants permission to make and distribute copies of any of his own materials on this site as long as such copies are -
(1) distributed only in their original,
unmodified form (but see the MODIFICATION paragraph below if you wish
to modify them for your organization's use); and are
MODIFICATION OF MACROS OR OTHER MATERIALS: On the other hand, with respect to (1) above, feel free to modify my macros or my other materials to suit your own needs or the needs of those in your organization, as long as you do not distribute them in any manner that would cause a reasonable person to assume the modified versions came from me. One way to do this is to prominently display a notice at the top of the macro code or other material (preferably in ALL CAPS) that the item has been modified, when, and by whom, and indicate where it has been modified in some obvious manner (i.e., special highlighting, colored text, etc.). Additionally, you should inform the recipients of the origin of the materials in separate documentation, email, etc.
INTENT: The simple intent of this section is to prevent recipients of any modified materials from assuming the materials were created entirely by the author, to prevent anyone from contacting the author for support of said modified materials, and to prevent damage to the author's reputation that may result from modifying (or charging a fee for) the author's work without permission.
I never, ever give out the name or address of anyone who contacts me without their written permission. NEVER, period.
I never, ever send unsolicited junk e-mail, otherwise known as "spam". I firmly believe most spammers are poorly socialized teenagers or underachieving hermits who have too much time on their hands, and should try to get a life. The rest are just idiots. I ignore all of them. (E-mail filters are a great help.)
